The parts people most want to know. Every price is all-in: shipping, handling, and tax are already included. Payment runs through Stripe, and we never see or store your full card number. All sales are final and we do not offer refunds, but every device is covered by a one-year manufacturer warranty against defects, and we will help you make a claim if something arrives faulty.
01Who we are & agreeing to these terms
This site, thzupgrade.com, is owned and operated by David Gantner, doing business as THzEssentials ("we," "us," or "THz Upgrade"), an independent authorized distributor of OlyLife products. We are the seller of record for purchases made through this site. The products are manufactured by OlyLife. This site is not OlyLife's official website and is not operated or endorsed by OlyLife.
By using this site or placing an order, you agree to these Terms of Sale & Use, along with our Privacy Policy and Disclosures & Disclaimers, which are part of these terms. If you do not agree, please do not use this site or place an order. You confirm that you are at least 18 years old and able to enter into a binding contract.
02Products & descriptions
We work to describe each device, its features, and its pricing as accurately as we can. Even so, product images are for illustration, and small differences in color, packaging, or included accessories can occur. Specifications and included items are subject to change by the manufacturer. If a product you receive differs in a material way from how it was described at the time of your order, contact us and we will make it right under the warranty terms below.
03Pricing
All prices are shown in U.S. dollars and are all-in: the price you see on the product card already includes shipping, handling, and applicable tax. The number shown is the number you pay at checkout. There are no surprise fees added later.
We may change prices at any time, but a change will not affect an order we have already accepted. If a price is listed incorrectly due to an obvious error, we may cancel the affected order and refund any amount charged for it, even though sales are otherwise final.
04Orders & payment
Payments are processed by Stripe, our third-party payment processor. When you check out, you enter your payment details directly with Stripe. We do not receive or store your full payment card number. Stripe handles card data in line with industry security standards (PCI DSS). Your use of Stripe's checkout is also subject to Stripe's own terms and privacy policy.
Submitting an order is an offer to buy. Your order is accepted when we confirm it or ship it, whichever happens first. We may decline or cancel an order, in whole or in part, for reasons including suspected fraud, a pricing or product error, items being unavailable, or an inability to verify your details. If we cancel an order you have paid for, we will refund the amount charged for the cancelled portion.
05Shipping & delivery
We ship to the address you provide at checkout, so please make sure it is correct. We are not responsible for delays or non-delivery caused by an incorrect or incomplete address. Estimated delivery times are estimates only and are not guaranteed.
To fulfill your order, we and the manufacturer may need to share the details necessary to ship to you. Shipping is included in the price for the 48 contiguous United States. If you are in Alaska, Hawaii, a U.S. territory, or outside the United States, contact us before ordering and we will quote any additional shipping charge for your location. Typical delivery is 5 to 15 business days from purchase. Risk of loss and title pass to you on delivery to the carrier. If a package arrives visibly damaged, note it with the carrier where possible and contact us promptly so we can help under the warranty.
06All sales are final
All sales are final. We do not offer refunds, returns, or exchanges, and there is no cooling-off or cancellation period once an order has been accepted. We display this clearly before you buy so there are no surprises, and we would genuinely rather you take your time and be certain before purchasing.
This no-refund policy does not leave you without protection if a device is defective: faulty items are covered by the manufacturer warranty described in the next section. Nothing in these terms limits any rights you may have under consumer protection laws that cannot be waived. Where such a law gives you a right we cannot exclude, that right still applies.
07Manufacturer warranty & faulty items
Every device is covered by a one-year manufacturer warranty against defects in materials and workmanship, provided by OlyLife as the manufacturer. If a covered device fails due to a defect during the warranty period, the remedy is repair or replacement under the warranty terms, not a refund.
If your device arrives damaged or faulty, or develops a defect within the warranty period, contact us at davidgantner@icloud.com and we will help you start a warranty claim. For items that arrive damaged or do not work on arrival, please contact us within 5 days of delivery. Keep your order confirmation as proof of purchase.
The warranty does not cover damage from misuse, accident, neglect, unauthorized repair or modification, normal wear and tear, or use that does not follow the product instructions. The warranty is the manufacturer's, and the manufacturer's current warranty terms govern what is covered and how claims are handled.
08Wellness, not medical, products
OlyLife products are general wellness devices, not medical devices. They are not intended to diagnose, treat, cure, or prevent any disease, and no statements on this site have been evaluated by the FDA. By purchasing, you acknowledge you have read our Disclosures & Disclaimers, including the health and wellness disclaimer and the guidance to consult your physician before use if any of the listed conditions apply to you.
09Acceptable use of this site
You agree to use this site only for lawful purposes. You will not attempt to interfere with the site's operation or security, access it through automated means in a way that burdens it, misuse any forms or checkout, or copy its content except as allowed below. We may suspend or restrict access if the site is being misused.
10Intellectual property
The text, layout, graphics, and other original content on this site are owned by us or used with permission and are protected by intellectual-property laws. You may view and share links to the site, but you may not copy, reproduce, or republish our original content for commercial use without our written permission. Product names, logos, and trademarks shown on this site belong to their respective owners and are used only to identify the products we sell.
11Disclaimers & limitation of liability
This site and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim implied warranties regarding the site itself, such as warranties of merchantability and fitness for a particular purpose, that are not expressly stated here. This does not affect the manufacturer warranty on the devices, which is described above.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, or consequential damages arising from your use of this site or a product purchased through it. Where liability cannot be excluded but can be limited, our total liability to you for any claim will not exceed the amount you paid for the product giving rise to the claim. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for fraud or for death or personal injury caused by negligence.
12Governing law & disputes
These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. You agree that any dispute relating to these terms or a purchase made here will be handled in the state or federal courts located in Maricopa County, Arizona, unless applicable law requires otherwise. If any part of these terms is found unenforceable, the rest remains in effect.
13Changes to these terms
We may update these terms from time to time. The version in effect when you place an order is the version that applies to that order. The effective date at the top shows the current version. Continuing to use the site after a change means you accept the updated terms.
